Implementasi Pelaksanaan Hadhanah Di Desa Kunyit Hulu Kecamatan Sungai Kunyit Kabupaten Mempawah

Abstract

Starting from the judge's decision on the hadhanah case which decided the custody of the child who had not been mumayyiz fell to his biological mother and the child's funding fell to his father. However, this is the opposite of the one in Sungai Kunyit Hulu village, where mothers go abroad as female workers (TKW) to meet the economic needs of children, seeing the reality of how Islamic Law views related to the above issue.

This type of research is Empirical juridical with a qualitative approach complemented by interviews and observations in data collection techniques. The implementation of Hadhanah in Sungai Kunyit Village has not been maximized as stipulated in the concept of Islamic Law.
