Praktik Penentuan Harga Dan Denda Dalam Arisan Bahan Pokok Lebaran Perspektif Hukum Ekonomi Syariah (Studi Kasus Sungai Jawi Luar, Kec. Pontianak Barat)

Abstract

Arisan is one of the traditions that is very popular in Indonesian society, especially in order to meet certain needs or needs. Currently, various new forms of social gatherings have emerged, one of which is the Eid staple gathering. This study aims to observe the practice of determining and applying fines in the gathering of Eid staples in Gg. Timun I, Sungai Jawi Luar, Kec. The method used in this study uses a qualitative deskriptif approach with data collection techniques through interviews. The informants are the head of the social gathering, social gathering participants, the surrounding community, and religious leaders in Gg. Timun I, Sungai Jawi Luar, Pontianak District. The results of the study show that the pricing of staples is carried out transparently. However, in practice, there is a profit taking by the chairman of the arisan from the difference between the amount of participant contributions and the total actual cost incurred to buy staples in the market. Even though the nominal amount is small, such actions are not justified if they are carried out without a clear contract, because they are contrary to the principles of justice (al-'adl) and trust in Islam. As well as the application of a fine of 15% to participants who stop in the middle of the road before the end of the social gathering is not fully in accordance with the principles of sharia economic law because it has the potential to cause injustice and is considered a personal gain.
