Tinjauan Maslahah Mursalah Pada Praktek Gadai Motor Di Desa Antibar

Abstract

Motorcycle pawning is one of the alternative solutions for the community in facing urgent economic needs. However, in its implementation, deviations from sharia principles are often found. This study aims to describe the practice of motorcycle pawning that occurs in Bukit Asam Hamlet, Antibar Village and analyze it through the maslahah mursalah approach, so that it is divided into two problems, namely: first, how the practice of motorcycle pawning is carried out by the community and second, how to analyze Islamic law on the practice based on the concept of maslahah mursalah.

This study uses qualitative research, with a descriptive approach and data collection is carried out by interview, observation, and documentation methods, all of which are to answer the problem: Tijauan Maslahah Mursalah on the Practice of Motorcycle Pawning in Antibar Village (Case Study in Bukit Asam Hamlet,  Antibar Village, East Mempawah District, Mempawah Regency).

The results of the study show that the practice of pawning motorcycles in the community is generally carried out simply and informally, without involving official financial institutions. The community does it as a quick solution to get cash, by handing over the motorcycle as collateral to the pawnbroker. A review of Islamic law on this practice shows that pawning is basically allowed in Islam as a form of help-help contract.
