Jual Beli Hewan Ternak Sapi Melalui Metode Taksir Di Desa Pasir Kecamatan Mempawah Hilir Kabupaten Mempawah

Abstract

The estimation method is a transaction based on the estimated weight and value with the naked eye without exact weighing, generally used by experienced traders and breeders. This is also commonly practiced by the people of Sand Village, Mempawah Hilir sub-district, West Kalimantan, in cattle buying and selling transactions.  The purpose of this research is to find out the views of Islamic law on the estimation method in buying and selling cattle and how this method meets the requirements for legal buying and selling according to Islamic teachings. A qualitative approach is used by collecting data through observation, interviews with farmers and traders, in sand villages and documentation. The results show that the estimation method is allowed in Islam as long as the conditions of buying and selling are met, namely a legal contract, the willingness of both parties, halal and publicly known goods, and a price agreement. In conclusion, buying and selling with the estimation method is legal in Islamic law if it is based on truth, clarity, and mutual agreement. This practice reflects the fiqh of muamalah which adjusts the social conditions of the community so that traditional buying and selling is free from usury and fraud, so that transactions are fairer and more transparent, and the estimation method remains relevant as long as the principles of law and trust are fulfilled.
