Praktik Jual Beli Pakaian Thrifting Melalui Tiktok Live Dalam Perspektif Hukum Ekonomi Syariah

Abstract

This study discusses the practice of buying and selling Thrifting clothes through the TikTok Live platform from the perspective of Sharia Economic Law. The phenomenon of Thrifting that is increasingly popular, especially among the people of Terusan Village, Mempawah Hilir, is an important object to be studied for its validity according to sharia principles. This research uses a qualitative approach with interview methods, and documentation of sellers and buyers on the TikTok Live platform. The results of the study show that technically this buying and selling practice meets the principles and legal requirements of buying and selling in Islam, such as the existence of an agreement (akad), the clarity of the goods, and the willingness of both parties. However, in terms of objects, imported used clothes that are traded are items that are prohibited according to positive law because they are categorized as illegal goods. From the perspective of sharia economic law, this transaction must still meet the principles of halal, honesty, transparency, and do not contain elements of gharar or dharar. Therefore, although it is legal in terms of contracts, this practice is not fully sharia compliant if it is not accompanied by compliance with state law. This research is expected to provide understanding for business actors to continue doing business in sharia and legally.
