Abstract

The Marriage Law not only regulates the lowest age limit for marriage, but also regulates the dispensation of the age of marriage as stated in Article 7 paragraph (2) of the Marriage Law No. 1 of 1974. The leeway that has been given by the law has resulted in many people using it, for various reasons. Based on data from the Mempawah Religious Court from 2010 to 2013, it always experienced a very significant increase every year. This is an interesting thing to study.

This type of research is normative juridical with a qualitative approach and data collection with observation, interviews and documentation. Factors causing the application for dispensation at the Mempawah Religious Court include being pregnant out of wedlock, wanting to get married only. The basis for the judge's consideration in granting marriage dispensation is to use normative, social and psychological considerations.
